No — once you're past $5,000 in rent through Split Pay for the year, Evolve has to issue the 1099-K. It's an IRS requirement, not optional, and it applies to every payment platform.
The form just records payments that already happened — it doesn't create a new tax bill. Whether you owed taxes on this rental income was already true; the 1099-K makes it official to the IRS.
